- Acceptance of Terms
By accessing or using the DismissalQ mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
- Description of Service
DismissalQ is a school dismissal management application that facilitates communication between parents, teachers, and school administrators during student pickup times. The App provides:
- Real-time student dismissal status tracking
- Location-based arrival notifications
- Alternate pickup request management
- Teacher dismissal management tools
- Multi-student support for families
- User Accounts and Registration 3.1 Account Creation
- Access to the App requires valid school-issued credentials
- You must provide accurate and complete registration information
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 18 years old to create an account 3.2 Account Security
- You are responsible for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
- We reserve the right to suspend or terminate accounts that violate these Terms
- Authorized Use 4.1 Permitted Use
You may use the App only for its intended purpose: managing student dismissal and pickup coordination with your registered school. 4.2 Prohibited Activities
You agree NOT to:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to the App or related systems
- Interfere with or disrupt the App’s functionality
- Share your account credentials with unauthorized individuals
- Use the App to harass, abuse, or harm others
- Submit false or misleading information
- Use automated systems (bots) to access the App
- Reverse engineer or attempt to extract source code
- Use the App to track individuals without proper authorization
- Location Services 5.1 Location Data Collection
The App uses location services to:
- Detect when you arrive at school during dismissal times
- Send automatic arrival notifications to teachers
- Improve the dismissal process efficiency 5.2 Location Permissions
- Location tracking is optional but recommended for optimal functionality
- You can enable or disable location services in your device settings
- Location data is only collected during active dismissal times
- Location data is never sold or shared with third parties for marketing purposes 5.3 Background Location
When enabled, the App may access your location in the background during dismissal hours. This feature: - Operates only during school-configured dismissal windows
- Is designed to minimize battery usage
- Can be disabled at any time in your device settings
- Student Information and Privacy 6.1 Student Data
- You may only add students for whom you have legal guardianship or authorization
- Student information is used solely for dismissal management purposes
- Student data is stored securely and protected in accordance with applicable privacy laws 6.2 Child Privacy
We comply with the Children’s Online Privacy Protection Act (COPPA): - The App is designed for use by parents/guardians, not directly by children
- We do not knowingly collect personal information from children under 13
- Parents/guardians control all student information in the App
- School Authorization 7.1 School Partnership
- Your school must be an authorized DismissalQ partner
- Schools control access to their dismissal management system
- Schools may revoke access at their discretion 7.2 School Policies
- You must comply with your school’s pickup and dismissal policies
- Schools may have additional requirements beyond these Terms
- DismissalQ is not responsible for school-specific policies or decisions
- Notifications and Communications 8.1 Push Notifications
- The App sends push notifications for dismissal status updates
- You can manage notification preferences in your device settings
- Critical notifications may be sent regardless of preference settings 8.2 Communications from Us
By using the App, you consent to receive: - Service-related announcements
- Updates about dismissal times
- Important security notifications
- App feature updates
- Intellectual Property 9.1 Ownership
The App, including all content, features, and functionality, is owned by DismissalQ and is protected by copyright, trademark, and other intellectual property laws. 9.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. - Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of location services
- Availability of the service at all times
- Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- DismissalQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount paid by you (if any) for using the App
- We are not responsible for delays, failures, or issues caused by circumstances beyond our reasonable control
- We are not liable for actions taken by schools, teachers, or other users
- We are not responsible for student safety during pickup or transportation
- Indemnification
You agree to indemnify and hold harmless DismissalQ, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Misuse of student information
- False or fraudulent information provided by you
- Third-Party Services
The App may contain links to or integrate with third-party services. We are not responsible for:
- The content or practices of third-party services
- Any damage or loss caused by third-party services
- The privacy policies of third-party services
- Changes to the App
We reserve the right to:
- Modify or discontinue the App at any time
- Change features or functionality
- Update these Terms (with notice to users)
- Suspend service for maintenance or updates
- Termination 15.1 By You
You may stop using the App at any time by deleting it from your device. 15.2 By Us
We may suspend or terminate your access if:
- You violate these Terms
- Your school revokes your authorization
- We discontinue the service
- Required by law or regulatory authorities 15.3 Effect of Termination
Upon termination: - Your license to use the App ends immediately
- We may delete your account and data
- Certain provisions of these Terms survive termination
- Governing Law
These Terms shall be governed by and construed in accordance with the laws of [State of Kentuck/USA], without regard to its conflict of law provisions.
- Dispute Resolution 17.1 Informal Resolution
Before filing any formal action, you agree to contact us to attempt to resolve any dispute informally. 17.2 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. 17.3 Class Action Waiver
You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits. - Miscellaneous 18.1 Entire Agreement
These Terms constitute the entire agreement between you and DismissalQ regarding use of the App. 18.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect. 18.3 Waiver
Our failure to enforce any provision does not constitute a waiver of that provision. 18.4 Assignment
You may not assign these Terms without our written consent. We may assign these Terms without restriction. 18.5 Force Majeure
